Pope & Howard, P.C. Wins $3 Million Medical Malpractice Case for Georgia Victim’s Family

Atlanta Trial Law Firm Obtains Seven-Figure Verdict in Dekalb County Case

(January 25, 2016) ATLANTA, GA — A DeKalb County jury returned a $3 million verdict in favor of the family of Brenda Davis, a 64-year-old woman who died two days after minimally-invasive gynecological surgery. The jury found that medical negligence on the part of the defendant gynecological surgeon caused her untimely death following this routine surgical procedure.

Atlanta-based personal injury firm Pope & Howard, P.C. represented the Davis family and won the case by proving that the surgeon was negligent in failing to address the victim’s symptoms after surgery. During a minimally-invasive procedure to remove an ovarian cyst, the victim’s bowel was pierced. After surgery, the patient’s symptoms were misidentified, ultimately leading to her death.

The jury found the gynecological surgeon negligent in failing to inspect the bowel adequately for cuts —an accepted danger of this particular surgery—and in his mishandling of the victim’s complaints after the procedure. By failing to identify the danger of her symptoms, the surgeon made a fatal error that violated the standard of care for his patient and ultimately led to her death.
