Partners Marc Howard and Geoff Pope Lead the Effort in the DeKalb County Case Against an OB-GYN
ATLANTA, GA — (November 11, 2019) Trial attorneys Marc Howard and Geoff Pope, of Pope & Howard, P.C. in Atlanta, Georgia, recently obtained a $12,000,000 million jury verdict in a birth defect medical malpractice case. Their client, eight-year-old Kendyl Gorman, suffered severe injuries after an obstetrician-gynecologist failed to provide adequate warnings that Benicar, a blood pressure medication, could result in fetal and neonatal abnormalities.
Kendyl, whose mother was on the blood pressure medication throughout her pregnancy, was born with injuries that will plague her the rest of her life. She had a stroke in utero, resulting in cognitive and neurodevelopment issues, and suffers from kidney problems that will necessitate a kidney transplant surgery later in life.
“We are very happy with the results of the case and that we could help Kendyl and her family receive just compensation,” Howard said.
While the Defendants’ counsel tried to show that Benicar’s literature clearly demonstrates the risk to a fetus, Kendyl’s parents never received any warnings from their own doctors, and even refilled a prescription for Benicar after the first OB-GYN appointment.
“It’s clear that no warnings were given, or Kendyl’s mother would never have continued taking the medication,” Pope added.
The jurors explained to the lawyers after the case that the multi-million-dollar verdict would be used to pay for all of Kendyl’s medical expenses, now and throughout her life.” Additionally, because the Defendants rejected a $1,000,000 settlement offer prior to trial, the Defendants will be required to pay attorneys’ fees and expenses.
“Hopefully, this case will encourage physicians everywhere to understand that they need to clearly warn pregnant patients who take dangerous medications of all the risks involved,” Howard said.
