New Study Proves Frivolous Medical Malpractice Suits Are a Myth

The argument that health care costs continue to rise due to frivolous lawsuits is a myth. According to a new study by the American Medical Association, less than 5 of percent medical malpractice cases make it to trial. Of those cases, nearly 80 were judged in favor of the physician, according to valawyersweekly.com.

The study included all claims closed by a professional liability insurer, (i.e. a medical malpractice insurance company) from 2002 to 2005. Of the 5 percent of cases that went to trial, only 4.5 percent ended with a trial verdict.
