Tracy Morgan Sues Wal-Mart After Truck Accident

Law suits are now being filed for the tractor trailer accident that left comedian Tracy Morgan hospitalized and fatally injured comedian James “Jimmy Mack” McNair.

On Saturday, June 7, 2014, Wal-Mart truck driver Kevin Roper allegedly fell asleep behind the wheel and failed to slow his tractor-trailer in traffic. He struck a Mercedes limo-bus chauffeuring Morgan, McNair, and fellow comedians Ardley Fuqua, Harris Stanton, and Jeffrey Millea to New York City.

Tracy Morgan, Ardley Fuqua, and Jeffrey Millea are now all named as Plaintiffs on the suit recently filed against Roper’s employer, Wal-Mart.

The law suit alleges that Wal-Mart’s “gross, reckless, willful, wanton, and intentional conduct” made the crash possible. According to authorities, the truck driver, Roper, hadn’t slept in the 24 hours before the fatal crash.

Regulations from the United States Department of Transportation (USDOT) state that truck drivers are permitted to work up to 14 hours per day, with a maximum of 11 hours spent behind the wheel. Truck drivers are also required to have at least 10 hours between shifts to sleep.

Tracy Morgan, Ardley Fuqua, Jeffrey Millea, and the family of James “Jimmy Mack” McNair will have the option of filing an additional law suit against the truck driver, Roper, for negligence.

It is possible for multiple parties to be found negligent after a tractor-trailer accident.
