Who’s at Fault in a Commercial Truck Accident?

As with any other form of collision, an accident involving a commercial truck can be caused by any number of things: weather, traffic, driver negligence, etc. However, sometimes fault may lie with the trucking company and not the driver; sometimes fault lies with both parties. It can even fall on the people who made the truck.

What Caused the Accident?

Determining that the accident was not your fault is the first step. Thoroughly documenting the scene of the accident and speaking with any witnesses are some of the best ways to help prove your side of the story.

Some collisions are more straightforward than others. For example, wrecks caused by poorly timed left turns will be easier to sort out than those caused by inclement weather. Continual unsafe driving on the part of the truck driver that has been brushed off or covered up by the company can cause fault to fall on both parties.

If the truck is owned by the trucking company and the truck belongs to them, fault is more likely to fall on the company, at least partially. If the driver owns their own truck and is operating as an independent contractor for the trucking company, the company may be relieved of responsibility completely.

What Does the Recording Technology Say?

In 2015, the U.S. Department of Transportation adopted a rule that requires all busses and commercial trucks to have electronic logging devices within two years. Many trucks are also outfitted with devices that track location and control speed, while others are more extensive and can gather data on the trucker’s driving habits. The data gathered from these devices can shed light on the safety of the driver’s behavior before and during the time of the accident.
